Please read the following Legal and Safety Terms and Conditions carefully before embarking on your journey. By booking and travelling with Super Travels, you acknowledge and agree to be bound by the clauses outlined below.
1. Compliance with Local Laws and Authorities
When travelling overseas, all passengers are strictly required to understand and obey the local laws, regulations, and customs of the destination country, city, or province. Travellers must not engage in any activity that constitutes a breach of local legislation. In the event that a passenger is detained, arrested, fined, or ordered by law enforcement or government authorities to rectify a legal violation, Super Travels assumes no liability whatsoever. The company is also under no legal obligation to provide legal defence, consular assistance, financial aid, or general intervention. Furthermore, the company is not responsible for issuing advance warnings regarding specific local laws. Passengers must fully comply with all lawful instructions issued by local authorities and must not resist, evade, or deviate from such directives.
2. Photography Restrictions and Sensitive Zones
Passengers are strictly prohibited from taking photographs, videos, or digital recordings of sensitive areas, including but not limited to military installations, government buildings, border checkpoints, and military or security personnel. Travellers must strictly observe and abide by all local signage, notices, and verbal instructions that restrict or forbid photography. Failure to comply with photography restrictions may result in severe legal penalties, including the confiscation of equipment, heavy fines, or imprisonment. Super Travels shall not be held legally liable for a customer’s failure to comply, nor is the company obligated to provide legal or logistical assistance in such circumstances.
3. Retail Purchases and Commercial Transactions
Any purchase of souvenirs, goods, services, or luxury items made by passengers at local shops, markets, or commercial outlets during the tour is strictly a private transaction between the customer and the merchant. Super Travels acts solely as a travel agent and does not endorse, guarantee, or warrant the quality, authenticity, safety, or legality of any items purchased. The company is not liable for fraudulent goods, defective products, or misrepresentations made by merchants. Super Travels is under no obligation to facilitate, negotiate, or assist in any refund claims, exchanges, or consumer disputes.
4. Tax Refund Procedures and Disclaimers
Tax refund regulations, standard operating procedures, and eligibility criteria vary significantly across different countries, cities, and provinces. While passengers may choose to attempt a tax refund claim for eligible purchases, the standard procedural framework generally requires the traveller to:
Depending on the jurisdiction, refunds may be processed in cash (which may incur a local administration or commission fee) or credited directly to a designated credit card upon provision of the card details.
The entire tax refund process is a personal administrative matter between the traveller and the respective government or third-party refund agency. Super Travels and its representatives (including tour leaders and guides) are not liable for the outcome of any claim, do not guarantee successful processing, and are under no legal or contractual obligation to assist the customer with any stage of the procedure.
5. Force Majeure and Restrictions
5.1 Definition of Force Majeure
For the purposes of this Agreement, a “Force Majeure Event” means any event or circumstance beyond the reasonable control of the Super Travels, which could not have been reasonably foreseen, prevented, or avoided. Such events include, but are not limited to: acts of God, natural disasters (including earthquakes, volcanic eruptions, hurricanes, or severe weather conditions), epidemics, pandemics, government-imposed travel restrictions, border closures, quarantines, war, hostilities, civil commotion, terrorism, strikes, industrial disputes, or the sudden insolvency or failure of third-party suppliers (such as airlines, hotels, cruise lines, or transport operators).
5.2 Mandatory Good Faith Negotiation Phase
In the event that a Force Majeure Event prevents, materially delays, or hinders the performance of any travel services, the Super Travels shall notify the Customer in writing or phone call as soon as reasonably practicable upon being able to facilitate the next course of action.
The customer acknowledges that Super Travels acts as an intermediary facilitator and does not directly control third-party suppliers. Therefore, a Force Majeure Event does not trigger an automatic or immediate right to a full cash refund. Instead, both parties shall negotiate in good faith to identify mutually acceptable alternative arrangements, which may include:
5.3 Supplier-Dependency and Cost Recovery
If the parties are unable to reach an agreement on alternative arrangements under Section 5.2, any subsequent financial remedy or refund shall be strictly governed by the following conditions:
Super Travels reserves the right to deduct and retain from any recovered funds including, but not limited to the following reasons:
The Travel Agent agrees to use its commercially reasonable endeavours to negotiate with suppliers and lobby for the return of deposits or prepayments on behalf of the Customer, but provides no guarantee that such third parties will waive their own cancellation or Force Majeure terms
